01 / Services and agreements
Swarna Solutions provides business-system setup, automation and support, including Swarna LeadDesk. These terms are intended to form part of the agreement presented when you subscribe to or order a service.
Service provider: SWARNA SOLUTIONS, CIPC registration number K2026359470. Business correspondence address: 45 Fransen St, Chamdor, Krugersdorp, 1754, South Africa. Contact: Nikail Singh, nikail@swarnasolutions.co.za.
A LeadDesk Agents subscription is for one individual using one personal account. It does not include agency seats, organisation creation or shared multi-user access. Separately contracted agency services have their own agreed scope.
Your accepted proposal, order or service agreement defines the actual scope, enabled features, support, charges and duration. If it conflicts with these general terms, the specifically agreed terms take precedence to the extent permitted by law. A demo or roadmap does not promise that every feature is available in every workspace.
02 / Your responsibilities
- Provide accurate account information and have authority to act for any business you represent.
- Protect your personal credentials, do not share your account, and tell us promptly about suspected unauthorised access.
- Only connect accounts and submit information you are entitled to use. Establish any notices, permissions and lawful basis required for your customers' information and communications.
- Do not use the services for unlawful activity, unsolicited bulk messaging, impersonation, security attacks or bypassing access and usage controls.
- Review drafts, AI-assisted output, quotes and proposed customer actions before relying on or approving them. Automated output can be incorrect.
Do not send account passwords, payment-card details or unnecessary sensitive documents through general support or intake channels.
Your POPIA responsibilities
Where you determine why and how customer or prospect information is used, you act as the responsible party under the Protection of Personal Information Act, 2013 (POPIA). You must ensure that your collection, import, use, disclosure and retention of that information are lawful. This includes providing required privacy notices, establishing and recording the appropriate lawful basis, keeping information accurate and relevant, protecting access, and responding to access, correction, deletion and objection requests.
Before authorising electronic direct marketing, you must meet POPIA's specific direct-marketing requirements, including obtaining consent where required or satisfying all conditions of an applicable existing-customer exception. You must honour withdrawals and opt-outs and keep appropriate evidence. A publicly available phone number, purchased contact list, approved template or available send button does not by itself establish permission to contact someone.
Your decisions remain your responsibility. Swarna provides software and agreed processing services but cannot independently verify the source, permissions or lawfulness of every record you supply, or control how you handle exported data or act outside the service. Using LeadDesk does not certify your POPIA compliance. To the extent permitted by law, Swarna is not liable for your unlawful data collection, instructions or communications where the resulting loss was not caused or contributed to by Swarna's own breach of its contractual or legal obligations.
You must give us lawful processing instructions and cooperate with reasonable requests to investigate suspected misuse or handle a privacy request. We may decline unlawful instructions or restrict affected access in accordance with these terms. This clause does not remove Swarna's own responsibilities as an operator or responsible party, including applicable security and breach-notification duties, or exclude any liability that cannot lawfully be excluded.
03 / Google Calendar and other integrations
Where enabled, LeadDesk displays titles and times from your selected Google calendars. Current connection permissions also support explicit event creation and deletion. Read the Google consent screen and the action confirmation carefully: deleting a Google event through LeadDesk removes it from Google too. Existing connections may require renewed authorisation. Disconnecting the integration removes its active cached events without deleting the original Google events.
Google Calendar remains the source of truth. Sync may be delayed, paused or interrupted; check Google before relying on availability for an important appointment. LeadDesk is not a guarantee against scheduling conflicts.
You can disconnect in LeadDesk or revoke access through Google. Disconnection, deletion and data handling are explained in our privacy policy. Calendar sync does not automatically contact customers or match events to leads.
WhatsApp outreach and business connections
LeadDesk’s connected WhatsApp messaging and inbox use Zernio and Meta/WhatsApp. You authorise the selected business account and number; feature availability depends on your verified connection and provider permissions. Where supported, WhatsApp Business app coexistence may make phone-app conversations visible in LeadDesk. Zernio’s terms of service and applicable Meta/WhatsApp rules govern the provider services.
Connect only business accounts and numbers you are authorised to manage. Review the recipient, message, purpose, consent or other lawful basis, and opt-out status before approving outreach. You must comply with applicable marketing law and WhatsApp, Meta and Zernio rules, including template and messaging-window requirements. Provider template approval is not recipient consent.
LeadDesk outreach remains owner-reviewed. Provider approval, an allowance or available credit does not guarantee delivery, replies or business results. A provider may reject a template, limit a sender or suspend an account; we can assist within the agreed support scope. New signup and profile-management features are available only when enabled and verified for your account.
Third-party services have their own terms, availability, quotas and account requirements. A provider may change or withdraw access. We do not represent that Swarna is endorsed or certified by Google, Meta or any other provider.
04 / Fees, changes and cancellation
Fees, billing intervals, usage allowances, taxes, third-party charges, renewal and cancellation arrangements are stated in the offer or agreement you accept. This public website is not a price list. You will be shown the applicable trial, subscription price and renewal arrangements before accepting a subscription.
Free trial and non-refundable charges: If you accept a free trial that converts to a paid subscription and do not cancel before the trial ends, billing begins at the price and billing interval you accepted. Subscription charges incurred after an uncancelled free trial are non-refundable, except where a refund is required by applicable law. Cancelling after billing begins stops future renewals in accordance with your subscription terms; it does not retrospectively reverse charges already incurred. Any mandatory cooling-off, cancellation or refund rights remain unaffected.
Existing subscriptions: any previously accepted LeadDesk/Canvass checkout or subscription terms continue to govern that subscription, subject to mandatory law. These general terms do not replace accepted trial lengths, allowances, recurring billing authorisations, cancellation provisions or refund arrangements. Renaming a product or publishing this page does not itself change that contract. Ask us for the version and order details applicable to your account.
Material scope or commercial changes require the notice or agreement specified in your contract and applicable law. Use the cancellation option provided for your subscription or email nikail@swarnasolutions.co.za to request cancellation or raise a billing concern. Disconnecting WhatsApp or Google, or requesting data deletion, does not by itself cancel a subscription; ask for cancellation explicitly so we can confirm the applicable end date. Any mandatory cancellation, refund or consumer rights remain unaffected.
05 / Information and ownership
You retain your rights in the information and materials you supply. You authorise the processing needed to deliver your agreed services, subject to the privacy policy and any applicable data-processing agreement. We remain responsible for our own legal and security obligations; customer responsibilities do not waive them. You are responsible for having the necessary rights in customer data you submit.
Data breaches, hacking and security responsibility
No online service can guarantee complete protection against hacking, malware, unauthorised access, data breaches or data loss. You must protect your devices and credentials, use available account-security controls, manage access to your information, and promptly report suspected compromise to us.
Limitation of liability: To the extent permitted by applicable law, Swarna Solutions is not liable for loss or damage arising from hacking, a data breach, unauthorised disclosure or data loss caused by your compromised devices or credentials, misuse of the service, or third-party attacks or failures beyond our reasonable control, provided that the loss was not caused or contributed to by our failure to meet our contractual or legal obligations.
This limitation does not exclude liability for our fraud, wilful misconduct or gross negligence, or any liability that cannot lawfully be excluded. It does not waive our duties under POPIA, including applicable security safeguards, oversight of service providers and breach-notification obligations. A third-party attack does not, by itself, release us from those duties.
Swarna and its licensors retain rights in their existing software, reusable templates, branding and methods. Ownership or licensing of bespoke deliverables is governed by your service agreement. Nothing here transfers ownership of your Google Calendar data to Swarna.
06 / Availability, support and ending service
Services may be interrupted by maintenance, connectivity, provider outages or security incidents. Any guaranteed service level must be expressly agreed. We do not guarantee sales, revenue, uninterrupted operation or error-free AI output.
We may restrict access where reasonably necessary to address abuse, a security risk, a legal requirement or a material breach. Where practicable, we will explain the issue and offer a reasonable opportunity to resolve it. Other suspension or termination rights follow your agreement and applicable law.
Before service ends, request any required export or handover from us. We will explain the available scope and process, subject to others' rights and applicable law. Data retention and deletion follow the privacy policy and your service agreement; ending a subscription does not erase records that must lawfully be retained.
07 / Legal rights, updates and contact
South African law applies, subject to any mandatory laws that protect you. Nothing in these terms excludes rights, remedies or responsibilities that cannot lawfully be excluded, including applicable consumer and data-protection rights. Any additional liability allocation must be set out in your agreement and remain subject to those laws.
We will identify and date updates to these terms. Changes to an existing service agreement follow its notice and acceptance requirements; publication alone does not override a specifically agreed contract.
